Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Falsy Run website and services (the "Service"), operated under the Falsy Run / Runcharted brand ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By using the Service, creating routes, purchasing tokens, or downloading any file generated by the Service, you confirm that you are at least 18 years old (or the age of legal majority in your jurisdiction) and that you have read, understood, and agree to these Terms.

2. Description of the Service

Falsy Run is a route-drawing and GPX file generation tool. It allows you to design routes on a map, set activity parameters (such as pace, date, and activity type), and download GPX files that you may use with third-party devices or platforms. The Service is a planning and file-generation tool only. It is not a fitness tracker, GPS watch, coaching service, or official activity recording platform. Files generated by the Service do not constitute proof that you personally performed any physical activity.

3. No Affiliation with Strava or Other Platforms

Falsy Run is an independent service. We are not affiliated with, endorsed by, sponsored by, or partnered with Strava, Garmin, Apple, Google, Mapbox (beyond being a customer of map services), or any other third-party fitness, mapping, or social platform. Any mention of Strava or similar platforms is descriptive only (for example, that exported GPX files may be compatible with those platforms). It does not imply authorization to circumvent, misuse, or violate those platforms' rules.

4. User-Created Routes and Content

You alone create, design, configure, and export routes and related data using the Service. You are solely responsible for: • the routes you draw and the locations they cover; • the pace, timing, date, activity type, elevation-related values, descriptions, and any other parameters you choose; • how you store, share, upload, or otherwise use any GPX file or data obtained from the Service; • ensuring that your use of the Service and of any exported file complies with all applicable laws and with the terms of any third-party platform you use.

5. Synthetic and User-Configured Data

GPX files and related outputs generated by the Service may include data that is estimated, interpolated, densified, user-selected, or otherwise synthetic. This may include, without limitation, timestamps, pace-derived timing, elevation values, track points, and activity metadata. Such data may not reflect a real-world activity you performed. You acknowledge that generated files can resemble completed activities when imported into third-party platforms, and you accept full responsibility for any consequences of uploading or presenting such files as genuine activity records.

6. Third-Party Platforms (Including Strava)

If you upload, import, sync, or otherwise use files or data from the Service on Strava or any other third-party platform, device, or service: • you do so entirely at your own risk and under that platform's terms and policies; • you are solely responsible for compliance with anti-cheat, authenticity, fair-use, community, and other rules of that platform; • we have no control over, and no liability for, account suspensions, bans, removals, disputes, reputational harm, or any other action taken by third parties as a result of your uploads or use; • we do not monitor, approve, or vouch for any activity file you create or upload elsewhere. You agree not to hold us responsible for any loss arising from your use of generated files on Strava or any other platform.

7. Safety, Legality, and Real-World Use

Routes drawn or exported through the Service may cross private property, restricted areas, unsafe terrain, or roads that are unsuitable for running or cycling. Map data may be incomplete or inaccurate. You are solely responsible for verifying that any route is legal and safe to use in the real world, for obeying traffic and local laws, and for not trespassing. We are not liable for injury, property damage, fines, or other harm resulting from following or attempting a route created with the Service.

8. No Guarantee of Accuracy

Distance, duration, elevation, road alignment, and other metrics shown or exported by the Service are estimates only and may be wrong. Map and routing data are provided by third parties and may contain errors. We do not warrant that any file, statistic, or map display is accurate, complete, reliable, or fit for a particular purpose, including training, competition, navigation, or submission to third-party platforms.

9. Tokens, Payments, and Guest Access

Certain features (such as GPX downloads) may require tokens purchased through our payment provider (for example, Stripe). Purchases may be offered on a guest basis, with token balance stored in your browser (for example, via a local token/JWT). You acknowledge that: • tokens may be tied to the browser/device where they are stored and may be lost if you clear storage, switch devices, or lose access; • unless required by mandatory consumer law, token purchases are generally non-refundable once processed; • pricing and token allowances may change; • payment processing is handled by third parties subject to their own terms. We are not responsible for payment-provider outages, failed charges caused by incorrect card details, or loss of tokens due to local storage clearing or device change.

10. Acceptable Use

You agree not to use the Service to: • violate any law or third-party terms (including Strava's or similar platforms' rules regarding fake, manipulated, or non-genuine activities); • misrepresent generated files as authentic records of activities you did not perform, where doing so would deceive others or breach platform rules; • harass, harm, or defraud others; • attempt to reverse engineer, disrupt, overload, or abuse the Service or related APIs; • circumvent payment, token, or usage limits except as expressly allowed. We may suspend or restrict access if we reasonably believe you are misusing the Service, without prejudice to other remedies.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, error-free, or free of harmful components, or that any content or file will meet your expectations or third-party platform requirements.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, ACCOUNT ACCESS, PLATFORM STANDING, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE OR ANY FILE GENERATED BY IT — INCLUDING UPLOADS TO STRAVA OR OTHER PLATFORMS, ACCOUNT BANS OR SUSPENSIONS, OR DISPUTES WITH THIRD PARTIES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR TOKENS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY EUROS (€50), WHICHEVER IS GREATER. Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by applicable law.

13. Indemnification

You agree to defend, indemnify, and hold harmless Falsy Run / Runcharted and our operators, affiliates, and service providers from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) routes, GPX files, or data you create or export; (c) your upload or use of such files on Strava or any other platform; (d) your violation of these Terms or of any third-party terms; and (e) any claim that your content or use caused harm to a third party.

14. Changes to the Service or Terms

We may modify the Service or these Terms at any time. Updated Terms will be posted on this page with a revised "Last updated" date. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Service.

15. Governing Law

These Terms are governed by the laws of France, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country of residence provide otherwise. Courts of competent jurisdiction in France shall have exclusive jurisdiction over disputes arising from these Terms, subject to any mandatory rights you may have as a consumer. These Terms constitute the entire agreement between you and us regarding the Service and supersede prior understandings on this subject.
